1. Agreement
These Terms of Use govern your access to the wireless internet service ("the Service") offered at Louis Park Hotel, operated by Louis Park Hotel LLC ("we," "us," "the Hotel"). By checking the acceptance box, connecting a device, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
The Service is provided free of charge as a courtesy to guests and visitors. It is offered on a best-effort basis. We do not guarantee availability, uptime, speed, bandwidth, latency, or continuous or error-free operation. The Service depends on third-party internet providers and may be interrupted without notice for maintenance, outages, or reasons outside our control.
Do not rely on the Service for any purpose where interruption would cause harm or loss, including medical monitoring, emergency communication, security systems, financial transactions, or business continuity.
3. Eligibility
You must be at least 18 years old to accept these Terms. A minor may use the Service only under the supervision of a parent or guardian who accepts these Terms on the minor's behalf and remains responsible for that use. We do not knowingly collect information from children under 13.
4. This Is an Open, Unencrypted Network
The Service is an open wireless network. Traffic sent over it is not encrypted by the network itself and may be visible to others within range. You use the Service at your own risk. We strongly recommend a virtual private network (VPN), that you access only sites secured with HTTPS, that you avoid transmitting sensitive personal, financial, or medical information, and that you keep your device's firewall and security software current and its file sharing disabled.
We do not warrant the security, privacy, or confidentiality of any data you transmit over the Service, and we are not responsible for interception, loss, corruption, or unauthorized access to it.
5. Acceptable Use
You agree not to use the Service to:
- violate any applicable federal, Louisiana, or local law or regulation;
- infringe copyright, trademark, patent, trade secret, or other intellectual property rights, including unauthorized downloading or sharing of movies, music, software, or games;
- transmit, store, or access child sexual abuse material, which we report to the National Center for Missing & Exploited Children and to law enforcement without notice to you;
- harass, threaten, stalk, defame, or intimidate any person, or transmit material that is obscene or unlawful;
- send unsolicited bulk email or messages, engage in phishing, or distribute malware, viruses, ransomware, or other harmful code;
- scan, probe, penetration-test, or attempt to gain unauthorized access to any network, system, device, or account, whether ours or a third party's;
- access any part of the Hotel's internal networks, systems, guest room devices, door locks, cameras, thermostats, printers, or network equipment;
- circumvent or attempt to circumvent authentication, filtering, bandwidth limits, session limits, or other access controls;
- impersonate another person, or use another guest's credentials or device without permission;
- resell, redistribute, or share the Service, or operate a wireless access point, router, hotspot, relay, proxy, VPN endpoint, or public server on the network;
- operate cryptocurrency mining, file-sharing servers, bulk automated scraping, or other activity that consumes bandwidth disproportionate to normal guest use;
- interfere with the Service or with other users' use of it, including by generating excessive traffic or radio interference.
6. Network Management
We may manage the network as needed to keep it usable for everyone. That includes limiting bandwidth per device, capping session length, limiting the number of devices per guest, blocking ports, protocols, or destinations, prioritizing traffic, and disconnecting or blocking any device. We may do any of these at any time without notice.
7. Monitoring and Logging
We log technical information about connections to the Service, including device hardware (MAC) addresses, assigned IP addresses, connection and disconnection times, access point used, and volume of data transferred. We use these records to operate and secure the network, investigate abuse, and respond to lawful requests. We do not routinely inspect the content of your communications, but we may examine traffic where necessary to investigate a suspected violation of these Terms, protect the network, or comply with legal process. 8. Copyright Complaints
We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act. Send notices to our designated agent: Louis Park Hotel LLC, hello@louisparkhotel.com, 1129 St. Philip Street, New Orleans, LA 70116. We may terminate Service access for repeat infringement.
9. Suspension and Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for any conduct we believe violates these Terms or harms the network, the Hotel, its guests, or any third party.
10. No Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
11. Limitation of Liability
To the fullest extent permitted by law, neither Louis Park Hotel LLC nor its owners, affiliates, employees, agents, or service providers will be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of data, profits, revenue, business, or goodwill, arising out of or relating to your use of or inability to use the Service. This applies regardless of the theory of liability and even if we were advised of the possibility of such damages.
This includes, without limitation, damages arising from interruption or unavailability of the Service; interception, loss, or corruption of your data; unauthorized access to your device or accounts; malware or other harmful code; the acts or omissions of other users; and the content or conduct of any third-party website or service you reach through the Service.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless Louis Park Hotel LLC and its owners, affiliates, employees, and agents from any claim, demand, loss, liability, damage, fine, penalty, or expense, including reasonable attorneys' fees, arising out of your use of the Service or your violation of these Terms or of any law or third-party right.
13. Privacy
Information you provide and information we collect automatically are handled as described in our Privacy Policy, which forms part of these Terms.
14. Changes
We may revise these Terms at any time. The version in effect is the one posted here when you connect. Continued use after a change means you accept the revised Terms.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Louisiana, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service must be brought exclusively in the state or federal courts located in Orleans Parish, Louisiana, and you consent to the personal jurisdiction of those courts.
16. Severability and Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions stay in full force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
